Lawyers criticize judges for bail decisions
"It is not possible to put out on the streets persons who constitute a social danger", said Rojas Nina
SANTO DOMINGO. The orders for release on a bail bond have become a sort of festival in favor of persons that do not have the requisitions needed given their dangerousness and repeated appearances in court for violent crimes.
This was the conclusion reached by jurists who were consulted about the events in which accused who are free on bail have been involved in.
The District Attorney for the National District, Alejandro Moscoso Segarra, the president of the Justice and Transparency Foundation, Trajano Vidal Potentini, Zacarias Payano Almanzar and the High Commissioner of the Human Rights, Domingo Porfirio Rojas Nina, expressed their preoccupations regarding the situation.
Moscoso Segarra said that the judges should know how to evaluate the case when the Justice Department asks for remand to custody, because the accused represents a danger to the society.
Vidal Potentini was in favor of judges that have issued decision that could be questioned because of the seriousness of the crime committed, should be investigated by the Supreme Court and have special attentions given to their decisions
He believes that there cannot be persons who represent a danger for the society in the streets and he is worried about where this is going.
Payano said that he understood that there is no uniform criteria for the granting of bail because it is being given to persons who are obviously a danger for flight.
Rojas Nina says that even though the Penal Process Code allows the magistrates to adopt six of seven ways of coercion, which favor the accused, the judges should act with prudence and tact.
"Above all they should look into the moral, social and even the personal conditions of the accused, something that is not happening with a lot of frequency in the many courts of the country."
